In these Terms and Conditions, “Aussie Farm Supply”, “we”, “us” and “our” refer to the operator of this website. “You” and “your” refer to the person or organisation using this website or purchasing products from us.
By using this website, creating an account or placing an order, you agree to these Terms and Conditions, along with our Privacy Policy, Shipping Policy and Returns and Refund Policy.
1. Using Our Website
You agree to use this website lawfully and only for its intended purposes.
You must not:
- Use this website for unlawful, fraudulent or malicious purposes
- Attempt to gain unauthorised access to the website, server or customer accounts
- Introduce viruses, malicious code or other harmful material
- Interfere with the operation, security or availability of the website
- Use automated systems to extract website content without our written permission
- Provide false, misleading or fraudulent information
- Use another person’s account without their permission
- Place orders using unauthorised payment information
We may restrict or suspend access to the website where reasonably necessary to protect our customers, systems or business.
2. Customer Accounts
You may be able to create an account to manage orders, addresses and account information.
You are responsible for:
- Providing accurate and current information
- Keeping your login details and password confidential
- Restricting access to your account
- Notifying us promptly of suspected unauthorised access
You are responsible for activity conducted through your account unless the activity resulted from a failure of our systems or security measures.
We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms and Conditions.
3. Product Information
We take reasonable care to ensure product descriptions, specifications, photographs, dimensions and other information are accurate.
Some product information is supplied by manufacturers, distributors or other suppliers. Packaging, colours, branding, product specifications and designs may change from time to time.
Product images are provided for illustrative purposes. Colours may appear differently depending on your screen and device settings.
Before placing an order, you should check that the product is suitable for your intended application. Please contact us if you require clarification about a product.
Nothing in this section excludes any right or remedy available under Australian Consumer Law where a product does not match its description, is not fit for a disclosed purpose or does not meet an applicable consumer guarantee.
4. Product Safety and Intended Use
Products must be used, installed, stored and maintained in accordance with the manufacturer’s instructions, safety warnings and intended purpose.
You are responsible for:
- Reading instructions and warnings before using a product
- Ensuring the product is suitable for the intended animal, property or application
- Using appropriate protective equipment
- Ensuring products are operated by suitably experienced or qualified people where required
- Keeping products away from children and animals where appropriate
Veterinary, animal health and agricultural chemical products should be used only as directed. Product information on this website is general information and is not a substitute for professional veterinary, agricultural or technical advice.
If you believe a product is unsafe, stop using it and contact us. Further information is available on our Product Recalls and Safety Notices page.
5. Placing an Order
When you place an order, you are making an offer to purchase the selected products at the price and on the terms shown during checkout.
After placing an order, you should receive an order confirmation. This confirms that we have received your order, but does not necessarily mean the order has been accepted or dispatched.
An order is accepted when we confirm dispatch or otherwise confirm that the order has been accepted for fulfilment.
We may contact you if:
- A product is unavailable or on backorder
- Additional delivery charges apply
- Product information or pricing contains an error
- We require additional information to process the order
- We are unable to verify the payment or delivery details
If we cannot accept or fulfil an order, we will notify you and refund any payment made for the unavailable or cancelled products.
6. Product Availability
Product availability displayed on our website may be based on information received from suppliers and may not always update immediately.
A product shown as available may occasionally become unavailable before an order is processed. Products may also be discontinued or placed on backorder without prior notice from the supplier.
If an ordered product is unavailable, we may offer you:
- A revised estimated dispatch date
- A suitable alternative product
- Cancellation of the affected product for a refund
- Cancellation of the complete order where appropriate
We will not substitute a product without your agreement where the substitute is materially different from the product ordered.
7. Prices and GST
Unless stated otherwise, prices displayed on our website are in Australian dollars and include Goods and Services Tax where applicable.
Delivery, freight and other applicable charges will be displayed during checkout or communicated to you before the order is dispatched.
We may change product prices at any time. A price change will not affect an order that has already been accepted, except where you agree to a change or where an obvious pricing error needs to be corrected.
If a product has been listed with an incorrect price, we will contact you before dispatch. You may proceed at the correct price or cancel the affected product for a full refund.
8. Payments
Payment must be made using one of the payment methods available during checkout.
Payments may be processed by third-party payment providers. Their separate terms and privacy policies may apply to the processing of your payment.
You confirm that you are authorised to use the selected payment method and that the payment information you provide is accurate.
We may delay or decline an order where payment:
- Is declined or reversed
- Cannot be verified
- Appears to be unauthorised or fraudulent
- Is subject to a payment dispute
9. Fraud Prevention
We may use fraud prevention measures to protect customers and our business.
Where an order is identified as potentially fraudulent, we may ask you to confirm information relating to your identity, payment method or delivery address.
We may decline or cancel an order where we reasonably believe it is fraudulent, unlawful or unauthorised. If a legitimate payment has already been received for a cancelled order, it will be refunded.
10. Shipping and Delivery
Shipping costs, processing times, delivery estimates, tracking and address requirements are explained in our Shipping Policy.
Some products are dispatched directly by our suppliers or distribution partners. Products within the same order may arrive in separate deliveries.
Delivery times are estimates and may be affected by product availability, supplier processing times, carrier delays, weather, public holidays and remote-area delivery requirements.
Where a delivery delay becomes known to us, we will take reasonable steps to provide you with updated information.
11. Heavy, Bulky and Oversized Products
Heavy, bulky, oversized or unusually shaped products may require specialist freight.
If the shipping amount calculated during checkout does not accurately cover the delivery cost, we may contact you with a revised freight quote before dispatch.
You may accept the revised freight charge or cancel the affected products for a refund.
You may be responsible for ensuring suitable access and unloading facilities are available at the delivery location. We will notify you before delivery where special unloading requirements apply.
12. Delivery Addresses
You are responsible for providing a complete and accurate delivery address.
We cannot guarantee that an address can be changed after an order has been placed because the order may already have been submitted to a supplier or warehouse.
Additional charges may apply where an order must be redirected or redelivered because the address provided was incorrect, incomplete or inaccessible.
This does not apply where the delivery problem was caused by us, our supplier or the delivery provider.
13. Authority to Leave
If you give authority for an order to be left unattended, the delivery provider may leave it in a location considered reasonably safe.
You accept the ordinary risks associated with an unattended delivery after the order has been delivered in accordance with your instructions. This does not exclude responsibility where the carrier fails to follow the delivery instructions or where responsibility cannot lawfully be excluded.
14. Order Changes and Cancellations
If you need to change or cancel an order, contact us as soon as possible at [email protected].
We will attempt to accommodate your request, but changes or cancellations cannot be guaranteed after processing has commenced.
Special-order, indent or customised products may not be eligible for cancellation once ordered from the supplier, unless required by Australian Consumer Law.
If an order has already been dispatched, it may need to be handled as a return under our Returns and Refund Policy.
15. Returns and Change of Mind
Returns must be requested and handled in accordance with our Returns and Refund Policy.
Change-of-mind returns may be accepted at our discretion subject to the conditions, timeframes and any applicable restocking or repackaging fees stated in that policy.
Change-of-mind conditions do not restrict your rights where a product is faulty, unsafe, incorrectly supplied, not as described or otherwise fails to meet a consumer guarantee.
16. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
17. Manufacturer Warranties
Some products may include a manufacturer’s warranty. Any manufacturer’s warranty is provided in addition to your rights under Australian Consumer Law.
The warranty period and conditions may differ between products and manufacturers. You may be required to provide proof of purchase, photographs, serial numbers or other information so a warranty claim can be assessed.
Contact Aussie Farm Supply if you need assistance with a product purchased from us. We may work with the manufacturer or supplier to assess the issue, but we remain responsible for providing any remedy that you are entitled to receive from us under Australian Consumer Law.
18. Product Recalls
If a product is subject to a safety recall, you should stop using it and follow the instructions in the applicable recall notice.
We may contact customers who purchased an affected product using the contact details provided with their order.
More information is available on our Product Recalls and Safety Notices page and through the ACCC Product Safety recalls website.
19. Promotions and Discount Codes
Promotions and discount codes may be subject to separate conditions displayed with the relevant offer.
Unless otherwise stated:
- Discount codes must be applied during checkout
- Only one discount code may be used per order
- Discounts cannot be exchanged for cash
- Discounts do not apply to delivery charges
- Discounts cannot be applied retrospectively
- Some products or brands may be excluded
We may cancel or refuse a discount obtained through fraud, technical error, misuse or a breach of the promotion’s stated conditions.
20. Supplier and Trade Accounts
Approved trade, supplier or wholesale accounts may receive separate pricing or discounts.
Account approval and discounts are subject to any additional conditions communicated during registration or approval.
We may review account eligibility from time to time. Any change will apply to future orders and will not alter the agreed price of an order already accepted.
21. Intellectual Property
The content of this website, including text, graphics, logos, icons, photographs, product information, page layouts and software, is owned by or licensed to Aussie Farm Supply and is protected by applicable intellectual property laws.
You may view and use the website for personal or legitimate business purchasing purposes.
You must not reproduce, republish, distribute, modify or commercially exploit website content without permission from the relevant rights holder, except where permitted by law.
Product names, logos and trade marks belonging to manufacturers and suppliers remain the property of their respective owners.
22. Third-Party Links
Our website may contain links to third-party websites.
We do not control those websites and are not responsible for their content, availability, security or privacy practices. A link does not necessarily indicate that we endorse the third party or its products and services.
23. Website Availability
We take reasonable steps to keep our website available and functioning correctly. However, access may occasionally be interrupted by maintenance, technical issues, security incidents or circumstances outside our control.
We do not guarantee that the website will always be available or free from errors. If a website error affects an order or payment, we will take reasonable steps to investigate and correct the issue.
24. Liability
To the maximum extent permitted by law, Aussie Farm Supply is not responsible for loss or damage caused by:
- Using a product contrary to its instructions or intended purpose
- Unauthorised alterations or repairs
- Incorrect installation, storage or maintenance by the customer or another person
- Normal wear and tear
- Information supplied by a customer that is inaccurate or incomplete
- Events outside our reasonable control
This section does not exclude or limit liability that cannot lawfully be excluded or limited, including liability arising under Australian Consumer Law.
25. Indemnity
To the extent permitted by law, you are responsible for loss suffered by Aussie Farm Supply as a direct result of your unlawful use of the website, fraudulent conduct or deliberate breach of these Terms and Conditions.
This provision does not require you to compensate us for loss caused by our negligence, breach of contract or unlawful conduct.
26. Privacy
We handle personal information in accordance with our Privacy Policy.
By placing an order, you acknowledge that we may provide information required to process and deliver the order to payment providers, suppliers, warehouses and delivery providers.
27. Changes to These Terms
We may update these Terms and Conditions to reflect changes to our business, website, suppliers, services or legal obligations.
Updated terms will be published on this page with a revised “Last updated” date.
Changes will apply to future website use and orders. The terms applying to an existing order will generally be those in effect when the order was placed, unless a change is required by law or agreed with you.
28. Severability
If any part of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.
29. Governing Law
These Terms and Conditions are governed by the laws applicable in the Australian state or territory in which Aussie Farm Supply’s operating entity is registered.
Nothing in this section prevents you from exercising any right available under applicable Australian consumer protection laws.
